Montana Last Will and Testament Form

The Montana last will and testament is a standard will document. This document is a legal document that will guide an individual (Testator) through the process of creating a document that would best reflect their wishes pertaining to the distribution of their estate after the Testators death. The Testator will also have the ability to name their executor of choice within the document. The Testator should select someone they trust to properly distribute their estate to their beneficiaries. This document may be changed or revoked at any time.

How to Write

Step 1 – The Testator shall begin by download the document – Enter Testator’s name at the top of the page. Proceed by:

  • Entering the Testator’s name into the next paragraph
  • City
  • County
  • Review “Expenses and Taxes”

Step 2 – Appoint an Executor – The Testator establish an executor by providing the following:

  • The name of the initial executor
  • Address
  • County of residence
  • State of residence

If the first selected executor is unavailable, an alternate may be established in advance. Enter the following:

  • Submit the name of the alternate
  • Address
  • County
  • State

Step 3 – Disposition of Testator’s Property –Enter all beneficiary information, if there are more beneficiaries than will fit onto this form, add a sheet with their information and attach it to the form

  • Beneficiary’s name
  • Address
  • Relationship
  • Enter the last four (4) digits of the beneficiary’s Social Security Number
  • The Testator must read over the paragraphs provided
  • If the Testator has additional instruction he/she may add a separate sheet and attach it to this document

Step 4 – Titled Sections – Should be closely reviewed by the Testator:

  • Omissions
  • Bond
  • Discretionary Powers of Personal Representative (subsections A through K)
  • Contesting Beneficiary
  • Guardian Ad Litem Not Required
  • Gender
  • Assignment
  • Governing Law

Step 5 – Binding Agreement – The Testator must read and agree to the first paragraph. Submit the following information:

  • The Testator’s name
  • Submit the date of the document’s executution (in dd/mm/yyyy format)
  • Testator’s name
  • Printed name
  • Date of Testator’s signature in dd/m/yy format
  • Testator’s printed name

Step 6 – Witness Signatures and Notary Public – All parties who will sign the document must be present before one another and before a notary for witness

Witnesses –

  • Witnesses signatures
  • Current addresses

Testamentary Affidavit –

  • The notary shall acknowledge this document after witnessing all signatures
  • The notary will provide the names of all involved parties
  • Testator will then enter their signature
