California Last Will and Testament Form

The California last will and testament is a document that is used by a Testator that would allow them to outline exactly how they would choose to divide their personal and real property after their death.  The document will allow the Testator to appoint an executor to ensure that the wishes of the testator are properly carried out according to their wishes.

How to Write

Step 1 – Download the document and establish the ownership, by entering the Testator’s full name

  • In the following paragraph submit:
  • The testator’s name
  • City of Residence
  • County of residence
  • Carefully review “Expenses and Taxes:

Step 2 – Personal Representative – The testator may appoint an executor by entering the following:

  • Name of the executor
  • Address
  • County
  • State

If the testator would like the option of an alternate executor enter the following:

  • Name of the alternate executor
  • Address
  • County
  • State

Step 3 – Disposition of Property – There are three spaces in which the testator may provide for a beneficiaries, of more are to be added, place all of the same information on a separate sheet, sign, date and attach to this form:

  • Beneficiary information –
  • Full name
  • Address
  • Relationship to Testator
  • Last 4 digits of social security number (beneficiary)
  • Enter the property to be awarded to the respective beneficiary
  • Read the remainder of the section

Step 4 – Titles and Subtitled Information – The testator must read the following:

  • Omission
  • Bond
  • Discretionary Powers of Personal Representative (A through K)
  • Contesting Beneficiary
  • Guardian Ad Litem Not Required
  • Gender
  • Assignment
  • Governing Law

Step 5 – Binding Arrangement – The Testator must read and agree to the information in this section and then submit:

  • The Testator’s name
  • Date the document is being executed in dd/mm/yyyy format
  • Testator’s signature
  • Printed name

Witnesses – The witnesses must sign within the presence of one another and before a notary public. The witnesses must read the witness statement. If in agreement enter;

  • Witnesses Respective Signatures
  • Complete Addresses

Step 6 – Testamentary Affidavit – The notary public will complete the affidavit section and witness the signatories signatures:

  • Testator Signature
  • Witnesses Signatures
  • Date of witness and recording by the notary in dd/m/yy format
  • Notary Signature and commission expiration
