Last Will and Testament VS Living Will

Last Will and Testament – This document is a standard will form to be used so that the Testator may enter into a guided written document, their desires with regard to how the Testator would decide to distribute their personal property, financial accounts and real property, to their beneficiaries. Living Will – This form is also known as an “Advance Directive.” This is a document that is provided to an individual (Principal) who would like to record their own medical treatment plan, while they are of sound mind to ensure that no one else is making their most private core decision to be implemented when the Principal is no longer able to express their own desires if or when they are facing an end of life situation. This form will also allow the Principal to select a health care agent if the Principal wishes, to ensure that all of the Principal’s advance instructions are properly honored.
