Nevada will forms are documents that are created to assist an individual in organizing both the distribution of their estate once the individual (Testator) passes away. Although this is a standard will, it will allow the testator to assign someone they trust to serve as an executor to honor the will according to how it’s written by the testator

A “living will” provides the ability to outline the the decisions that the individual (Principal) would wish to implement when they are no longer able to care for or make their decisions on their own.  If the Principal would like, they may also take the opportunity to appoint a health care agent to make decisions on their behalf in the event the Principal becomes unable to communicate their own medical choices. These documents, once completed, but be witnessed and/or notarized. The documents may be revoked or changed by the individual only, as long as they are of sound mind to do so.

Last Will and Testament VS Living Will

Last Will and Testament – A standard will, the Testator may use to provide a written record of the Testator’s instructions with regard to how the Testator would instruct their executor to distribute their personal property, financial accounts and real property, to their beneficiaries at the Testator’s time of death. If the Testator would like to appoint an executor to delegate powers, this too, may be done within this document. This document may be changed or it may be revoked at any time.

Living Will – May be referred to as an“Advance Directive.” This document is designed so that an individual (Principal), will have the opportunity to clearly outline their preferred medical treatment options, that would be implemented when the Principal reached a point that they are no longer able to make their own decisions  This document will also allow the Principal to select a health care agent to ensure that all advance instructions that the Principal sets forth in the document, are honored. This document must be prepared while the Principal is of sound mind. The form may also be revoked at any time as long as the Principal is of sound mind to do so.
