Last Will and Testament VS Living Will

Last Will and Testament – The Testator may prepare this document to name their beneficiaries and an executor as well, to record the desired distribution of their estate once the Testator passes away. The executor will be responsible to honor the written wishes of the Testator in the division of the personal, real property and any financial accounts to be distributed.

Living Will – This form is usually also referred to as an“Advance Directive.” The document is designed so that an individual (Principal), would have the ability to prepare for their end of life medical care according to their own wishes. The form will be made available to their health care agent and their medical team so that they may refer to it to be certain that the Principal’s wishes are honored These instructions provided by the Principal would be implemented once the Principal is no loner able to make any further decisions for themselves.This form will also allow the Principal to select a health care agent within the confines of this form.
