Last Will and Testament VS Living Will

Last Will and Testament – This form is a standard will. The Testator would use this document to provide a written record of the Testator’s specific instructions with regard to how the Testator would instruct their selected executor to distribute their personal property, financial accounts and real property, to their beneficiaries at the Testator’s time of death. If the Testator has the intention of naming an executor to delegate powers, this may be accomplished within this document.

Living Will – This form would also referred to as an “Advance Directive.” The document is created so that an individual (Principal), while they are of sound mind, will have the opportunity to record their preferred medical treatment options, that would be implemented once the Principal is no longer able to make their own decisions  This form will also allow the Principal to select a health care agent to ensure that all advance instructions are honored according to the instructions of the Principal.
