Last Will and Testament VS Living Will

Last Will and Testament – This form is a standard will. The Testator may use this document to record their specific instructions with regard to how they would prefer to distribute their personal property, financial accounts and real property, to their beneficiaries at the Testaror’s time of death. If the Testator intends to delegate powers to a trusted someone to divide their estate, this information may be included in this document.

Living Will – This document is often referred to as an “Advance Directive.” This is a document that is provided to an individual (Principal) so that they may record their own medical treatment plan or at least their options, that would be implemented when the Principal is no longer able to make their own decisions or in an end of life situation. This form will also allow the Principal to select a health care advocate to ensure that all advance instructions are honored.
