Illinois Will Forms | Last Will and Testament | Living Will

Illinois will forms are documents that will provide two separate functions. The “will” document provides an opportunity for the Testator to prepare a document that would outline the distribution of their estate after death. The living will, allows the Principal to dictate their choice of instructions as to how they would like to have their medical treatment implemented at a time when the Principal is no longer able to express their own decisions so that their health care representative and medical providers are aware and may honor the Principal’s wishes to the best of their ability. The documents may be changed or revoked at the Principal’s discretion at any time as long as the Principal is of sound mind while making the changes or revocations.

Last Will and Testament VS Living Will

Last Will and Testament – This is a standard will whereas the Testator may place into writing, their instructions with regard to how they would choose to distribute their person property, real property and any financial accounts.  This document would be created while the Testator is of sound mind, but utilized by their selected executor after the death of the testator.

Living Will – This document is also recognizes as an “Advance Directive.” This is a document will allow an individual also known as a “Principal” to create a written record of selections for medical treatment options when or if the Principal becomes unable to make their own medical decisions any longer. The Principal may use this document to appoint a health care representative should they so desire. If not the document would be made available to the medical team for any further decision making pertaining to how they should proceed while doing their best to honor the medical wishes of the Principal
