Florida will forms are legal documents that will assist an individual, while they are of sound mind, in organizing their end of life choices so that their wishes may be recorded in writing and appropriately carried out, whether these are instructions for medical decisions or distribution of personal and real property. The documents will provide the ability to select an attorney in fact/agent for each document. These selected agents will consist of persons with whom an individual holds trust, to be certain that their instructions, whether they are health care and medical or distribution of property after their death, are carried out as stated within the document (to be used as the agent’s reference) by the individual who has prepared the document. One of the best ways to ensure that an individual’s choices are honored and legally guarded, would be to complete one or both documents. The documents will require witnesses and/or notarization before they shall be effective. These documents may be revoked or changed at any time the person may feel it would be necessary for any reason, as long as they continue to be of sound mind.

Last Will and Testament VS Living Will

Last Will and Testament – This document is a standard will document that allows a Testator to create a legal document that will outline the distribution of their property to their chosen beneficiaries after death. The document will allow the testator to delegate an executor to oversee the proper distribution of their estate according to their wishes.

Living Will – Also known as an “Advance Directive,” which is a document that is prepared by the Principal, while they are of sound mind and would like to provide specific instructions with regard to medical choices as they would like them to be when they are facing an end of life situation, leaving little if anything to question for family or medical team decision making processes.
