West Virginia will forms are designed to serve persons in different ways. For a person who would like to prepare their estate and medical choices in advance; the “last will and testament” will assist in guiding the user through creating a standard will. This document will also offer provision for delegation of an executor to ensure that the estate is honorably distributed to the Testator’s beneficiaries, after the Testator’s dies.

The “living will,” is a form that will shall provide assistance to the user, also identified as the “Principal,” to prepare a record, in writing, that will specify preferred medical treatment when the Principal is no longer able to make and/or convey their own medical decisions to their physicians of their own accord. The document will provide the medical providers and any health care agent the instructions set fourth by the Principal. The form will also allow the Principal to name a health care agent, if they haven’t already done so. The documents must be completed by the Principal, while they are sound mind. Either document may be revoked by the individuals at any time.

Last Will and Testament VS Living Will

Last Will and Testament – This form is a legal document. It is a standard will form that the Testator would use this to provide record of the Testator’s desired instructions pertaining to how the Testator would instruct their selected executor to distribute their estate, to include personal property, financial accounts and real property, to their beneficiaries after the Testator’s death. If the Testator would like to appoint an executor to distribute their property, this may be accomplished by applying the required information on this form.

 

Living Will – This legal document, also referred to as an “Advance Directive.” The document is designed so that an individual (Principal), will have the ability to be easily guided through the process record their preferred medical treatment options, that would be implemented once the Principal is no longer able to make their own decisions, while they are of sound mind.  The document form will also allow the Principal to select and document a health care agent to ensure that all advance instructions are honored by their medical team. These documents may be revoked at any time the Principal would deem necessary.
