Wisconsin will forms are legal documents, have been designed to help the user create documents that will help them prepare for their end of life processes. The “living will” is a form that will provide information for the Principal’s physicians and health care proxy (one who will help make health care decisions) so that they will be able to refer to the document to ensure that the end of life’s decisions are honored.

The “last will and testament” is a document that is prepared by a person (testator) who would like to prepare instructions for their executor to distribute their estate once they are deceased, to their beneficiaries. Although the documents are different, they do serve one purpose; to prepare for their death. Both documents may be changed or revoked if the person feels it’s necessary.

Last Will and Testament VS Living Will

Last Will and Testament – This form is a legal document. It is considered a standard will form. The Testator would use the document to offer a  record of the Testator’s desired instructions pertaining to how the Testator would wish to instruct their executor to distribute their estate. Estates often include personal property, financial accounts and real property or any property that the testator would like to leave to be passed on to their beneficiaries after the Testator’s death. If the Testator would like to appoint an executor to divide their property, this may be accomplished with the provision of the appropriate applicable information on this form.

Living Will – This legal document, also referred to as an “Advance Directive.” The document is designed so that an individual (Principal), will have the ability to provide record their preferred medical treatment options, that would be implemented once the Principal is no longer able to make their own medical decisions, while they are of sound mind.  The form will also allow the Principal to select a health care agent to ensure that all advance instructions are honored by their physicians.
