Virginia will forms are legal documents that assist a person in preparing for end of life situations. A “living will” is a form that will allow a person (Principal) to arrange in writing, their end of life wishes pertaining to their medical care. This document would allow the Principal to assign a representative (health care agent) to be certain that there would be someone to monitor their health care when they are no longer able to do so on their own. The document must be completed while the Principal is of sound mind.

A “last will and testament” is a document that will allow a person (testator), while they are still of sound mind, to plan the distribution of their estate. They will have the ability to delegate powers to another person (executor) to divide their will among their beneficiaries, after the testator is deceased. The executor must consider the wishes of the testator when they are distributing their property to ensure that the testator’s wishes have been completely met according to their will document

The documents may be changed or revoked at the discretion of the testator. Each new document will revoke the previous document immediately.

Last Will and Testament VS Living Will

Last Will and Testament – This form is a legal document. Considered a standard will form, the Testator would use this document to create a record, while they are still of sound mind, of the Testator’s desired instructions regarding how the Testator wishes to instruct their chosen executor to distribute their estate, to their beneficiaries after the Testator’s death. If the Testator still needs to appoint an executor, they may do so within this document.The document may be changed or revoked at the testator’s will.

Living Will – This legal document is also be referred to as an “Advance Directive.” The document is available to an individual (Principal), so that they will have the ability to record their preferred medical treatment options in the event they are under end of life circumstances and are no longer able to express their wishes to their physicians.

The Principal would be able to appoint a health care agent who would serve the Principal by assisting medical providers in the decision making processes with regard to continuation or withholding of treatment. The document would be implemented to allow the health care agent to assist, once it has been determined by the physicians that the Principal is no longer able to make their own decisions.  The document must be completed while the Principal is of sound mind and may be revoked at any time.
