Utah Last Will and Testament Form

The Utah last will and testament is a legal document that would be completed by an individual (testator) to prepare, for the distribution of their estate. The document will allow the Testator to elect an executor to divide the estate after the testator’s death. The form will allow the Testator to also name all of their beneficiaries and list all of their information. The form must be completed while the testator is of sound mind and the executor must consider all of the written instructions as the division of the property takes place, in order to properly honor the Testator’s wishes. The form will require two witnesses in order to be legally effective per 75-2-502. It may also be revoked as the testator deems necessary.

How to Write

Step 1 – Download the document –Enter the testator’s name at the top of the page. Proceed to the next paragraph and submit:

  • The testator’s name
  • City of residence
  • County of residence
  • Read“Expenses and Taxes”

Step 2 – Establishment of Personal Representative (executor) – establish an executor by entering:

  • The name of the representative
  • Address
  • County and state of residence

If the first selected executor is unavailable, an alternate may be established in advance. Provide the following:

  • Alternate’s representative’s name
  • Address
  • County of residence
  • State of residence

Step 3 – Division of Testator’s Property –Provide all beneficiary information as follows:

  • Beneficiaries names
  • Full Addresses
  • Relationships to testator
  • Provide the last four (4) digits of the beneficiary’s Social Security Number
  • The Testator must review the next paragraphs
  • If additional instructions are needed, add an additional sheet and attach it

Step 4 – Titled Sections and Subsections –

  • Omissions
  • Bond
  • Discretionary Powers of Personal Representative (subsections A through K)
  • Contesting Beneficiary
  • Guardian Ad Litem Not Required
  • Gender
  • Assignment
  • Governing Law

Step 5 – Binding Agreement – The Principal should read and agree to the first paragraph. Submit the following:

  • Testator’s full name
  • Enter the execution date of the document – (dd/mm/yyyy)
  • Testator’s signature
  • Printed name
  • Date of  signature (dd/m/yy format)
  • Testator’s name

Step 6 –  Signatures of Witnesses –

  • Witnesses (respective) signatures
  • Addresses (currently)

Testamentary Affidavit (Optional) –

  • The notary shall witness and record signatures
  • Testator’s signature
  • Witnesses signatures
