Utah will forms are documents that are used by persons who would like to prepare at any time, for their end of life situations. The “last will and testament,” is a document whereas the testator would have the ability to set fourth the distribution of their estate. The form will allow the testator to delegate powers to a trusted executor to divide their estate as stated, after the testator’s death.

The “living will” document will allow a person (Principal) to record their wishes with regard to their wishes regarding end of life medical treatment. The document will guide the Principal through the process of directing their physicians and their health care agent (if any) with their wishes pertaining to how what sort of medical treatment they would like continued or withheld when they are no longer able to verbally, or in any way, communicate their choice of medical options. These documents will require witnesses and/or notarization in order to be legally effective.

Last Will and Testament VS Living Will

Last Will and Testament – This document would be completed by a person (Testator) who would use this document to plan and record how they would like their estate to be divided between their chosen beneficiaries. Once the testator is deceased, their trusted representative (executor) would distribute the testator’s property according to  their wishes. If there has been no executor named, the testator may do so within this form.

Living Will – This form is also known as an “Advance Directive,” is a form that would be prepared by a person(Principal) who wishes to prepare in advance for their health care in the event they are faced with end of life circumstances. This document would allow the Principal to select the treatment at the end of their life. This will provide their own written and recorded instructions that would be made available to their medical team and health care agent.
