A “last will and testament” is a document that would allow a person (Testator) to prepare a written record of how they would like their estate for distribution to their chosen beneficiaries, after their death. This document will allow the testator to also name an executor to distribute the estate. They will be able to provide beneficiaries information. The document must be completed only by or in the presence of the Testator while they are of sound mind. The document may be changed or revoked at any time.

Last Will and Testament VS Living Will

Living Will – Also be referred to as an“Advance Directive.” This document is designed so that any person (Principal), would have the ability to properly outline the medical treatment options that they would prefer. The document would be implemented when the Principal reaches a point that they are no longer able to make their own health care decisions. This document will also allow the Principal to select a health care agent to ensure that the Principal’s instructions are honored as written . The document must be completed while the Principal is of sound mind. The form may also be revoked at any time.
