Last Will and Testament VS Living Will

Last Will and Testament – Is a legal document (standard will), that the Testator may use to create a written record of the Testator’s choices and instructions as to how the Testator would like the executor to distribute their estate after the Testator’s death. If the Testator would like to delegate an executor, this too, may be done within this document. This document may be changed or revoked at any time as long as the Testator continues to be of sound mind.

Living Will – Also be referred to as an“Advance Directive.” This document is designed so that any person (Principal), would have the ability to properly outline the medical treatment options that they would prefer. The document would be implemented when the Principal reaches a point that they are no longer able to make their own health care decisions. This document will also allow the Principal to select a health care agent to ensure that the Principal’s instructions are honored as written . The document must be completed while the Principal is of sound mind. The form may also be revoked at any time.
