Nebraska will forms are documents that individuals may use to prepare for an end of life situation, whether the person is elderly, terminally ill or even if the person is of age and would like to simply ensure that their possessions are distributed as they wish. They may also wish to prepare their “living will” which is a document that an individual would use to outline their decisions if/when, they are faced with end of life circumstances. This document will provide instructions to the Principal’s medical providers, health care agent as well as family the medical instructions they would like to have honored when they are no longer able to make their own decisions. Last Will and Testament VS Living Will

Last Will and Testament – Any person (Testator) of legal age would use this standard will document, to create a record of the individual’s instructions pertaining to how the Testator would instruct their executor to distribute their personal property, financial accounts and real property, that they wish to pass on to their beneficiaries after the Testator passes away. If the Testator intends to name an executor to distribute their estate, this document will provide the ability to name an executor of their choice. This document may be changed or revoked at the testator’s discretion.

Living Will – Often better known as an “Advance Directive.” This form is designed for the purpose of allowing an individual (Principal), the opportunity to specify their preferred medical treatment. This document would only be implemented when there is certain that  the Principal is no longer able to make or communicate their own medical decisions. This document is brief and specific. If the Principal would like to add more instructions for medical providers and/or a health care agent, they may provide additional written sheets with any additional wishes or instructions and attach them to the document. This document may be revoked at any time, as long as the Principal is of sound mind to do so.
