North Carolina will forms legal documents that are used to prepare for separate aspects of end of life circumstances. A “last will and testament” would completed by an individual in order to organize the distribution of their estate after the testator dies. The “living will” is a written record that one would complete, providing a statement for their medical providers, health care agent and family members so that everyone will know the Principal’s exact wishes, when they are no longer able to make their own health care decisions. Last Will and Testament VS Living Will

Last Will and Testament – Is a standard will that is made available for a Testator to complete to specify their instructions pertaining to how they would wish to have their executor distribute their personal property, financial accounts and real property and any other aspects of their estate, to their beneficiaries, after the death of the testator. Should the individual choose they will also have the ability to delegate an executor by entering the required information into the form.

Living Will – This document is what is generally known as an “Advance Directive.” This document is provided so that an individual (Principal), provide the ability to enter into writing their personal medical choices. The document would be made available to the Principal’s medical providers a well as their health care agent. The document would go into effect when the Principal is no longer competent to make their own decisions This form will also allow the Principal to select a health care agent to ensure that all advance instructions are honored per the Principals choices.
