Mississippi will forms are documents that allow an individual to record their wishes for their end of life plans for both their estate as well as their medical decisions. The “last will and testament” will serve the individual (Testator) by guiding them through the process of naming their beneficiaries, naming an executor and recording the division of their estate, which will take place after the testator’s death

The “living will” serves the individual (Principal) by guiding them through the process of declaring their wishes with regard to end of life medical care. Either document used, must be completed while the individual is of sound mind. Once these documents are completed they must be signed by witnesses and/or notarization. The documents may still be changed or revoked at the discretion of the author.

Last Will and Testament VS Living Will

Last Will and Testament – The Testator would use this standard will document, to provide record of the individual’s (Testator’s) instructions pertaining to how the Testator would instruct their selected executor to distribute their personal property, financial accounts and real property, to be passed on to their beneficiaries at the Testator’s time of death. If the Testator intends to name an executor to divide the estate, they may do so within the pages of this document

Living Will – Is also known as an “Advance Directive.” This form is created so that an individual (Principal/declarant), will have the opportunity to outline their preferred medical treatment plans. These plans would be implemented only at a time when there is no doubt that  the Principal is no longer able to make or communicate their own decisions  This form will also allow the Principal to select a health care agent to ensure that all advance instructions are honored according to the instructions of the Principal.
