Kansas will forms are documents that are designed to serve different purposes. A last will and testament allows an individual to plan the  distribution of their complete estate to their chosen beneficiaries. The form also allows the Testator to delegate a trusted executor. The living will provides written record for an individual who would like to plan their medical treatment in advance, if/when an end of life situation should occur. Both documents will require the signatures of unrelated witnesses and notarization. The documents may be revoked by the individuals should they wish.

Last Will and Testament VS Living Will

Last Will and Testament – This is a standard will document. The Testator will provide in writing, their instructions with regard to how they would like to distribute their personal property, financial accounts and real estate, to their chosen beneficiaries. The Testator will have the ability to delegate a trusted executor within the contents of this document to ensure that their estate is distributed according to the author of the document.

Living Will – Also known as an “Advanced Directive,” this document is provided to an individual often referred to as the “Principal,” so that they direct their end of life medical care in advance of any catastrophic health scenario. The document allows the Principal to plan their own medical treatment plan, only to be implemented when the Principal is no longer able to make their own decisions. This document will also allow the Principal to select a health care agent to ensure that all advance instructions are honored according to the written and witnessed document
